AlchemyNow Terms of Service

These Terms of Service (the "Terms") govern access to and use of the AlchemyNow website, content, memberships, and related services made available through alchemynow.ca (the "Services"). Website terms for subscription services should clearly describe the nature of the services, payment terms, automatic renewal mechanics, cancellation rights, acceptable use, intellectual property, and liability limits.

By accessing or using the Services, creating an account, purchasing a membership, or otherwise engaging with AlchemyNow, the user agrees to be bound by these Terms. If the user does not agree to these Terms, the user should not use the Services.

About the Services

AlchemyNow provides subscription-based digital meditation content, including guided meditation audio and related wellness content intended primarily for families, including children, teens, parents, and prenatal audiences.​ Access to paid content may require creation of an account and payment of recurring subscription fees through the website or related checkout tools.

AlchemyNow may update, modify, suspend, or discontinue any part of the Services from time to time, including content libraries, features, access methods, pricing, or membership offerings, with or without prior notice where permitted by law.

Eligibility

The Services are intended for users who are legally capable of entering into a binding agreement in their jurisdiction. Because the content is family-oriented, adult account holders are responsible for supervising use by children or other household members who access the Services through their account.​

Users must provide accurate, current, and complete information when creating an account or purchasing a membership, and must promptly update that information if it changes. A user is responsible for maintaining the confidentiality of account credentials and for all activities that occur under the account.

Accounts and Access

AlchemyNow may require account registration to access some or all portions of the Services. The user agrees not to share login credentials outside the user’s household, impersonate another person, attempt unauthorized access, or interfere with the security or operation of the Services.

AlchemyNow may suspend or terminate access to the Services if these Terms are violated, if payment fails, or if use of the Services creates legal, security, or operational risk. Squarespace and subscription-service terms commonly reserve the right to suspend or cancel paid access when fees are unpaid or terms are breached.

Memberships, Billing, and Renewals

AlchemyNow offers subscription-based access to digital content. Subscription services should disclose whether payments are recurring, how renewals work, what happens if payment fails, and how cancellations are handled.

Unless expressly stated otherwise at checkout, memberships renew automatically on a recurring basis matching the selected billing period until canceled. Charges will be processed through the payment method provided at checkout using Stripe through Squarespace or another processor used by AlchemyNow from time to time.

The user authorizes AlchemyNow and its payment processor to charge the applicable subscription fees, taxes, and any other clearly disclosed charges to the user’s payment method on each renewal date until cancellation. If a payment is declined or cannot be completed, AlchemyNow may retry the charge, suspend access, or cancel the membership until payment is successfully received.

Pricing and Changes

Pricing for memberships will be displayed at the time of purchase. AlchemyNow may change subscription prices, plans, features, or billing terms prospectively, and any such changes will apply only after notice where required by law and after the then-current billing period unless otherwise permitted by applicable law.

Promotions, discounts, trials, and introductory offers may be subject to additional terms presented at the time of the offer. Unless explicitly stated otherwise, promotional offers cannot be combined and may be modified or discontinued at any time.​

Cancellations and Refunds

The user may cancel a membership at any time through the account settings, the applicable billing portal, or by contacting AlchemyNow using the contact information provided on the website. Subscription-service terms commonly state that cancellation stops future renewals but does not retroactively reverse charges already incurred for the current term.

Unless required by applicable law, fees are non-refundable once charged, including for partial billing periods, partial use, or failure to use the Services during an active subscription term. If AlchemyNow offers any discretionary refunds, credits, or exceptions, doing so in one case does not obligate the same outcome in another case.

Permitted Use

Subject to these Terms, AlchemyNow grants the user a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use. The user may not copy, sell, sublicense, distribute, publicly perform, publicly display, scrape, reverse engineer, or exploit the Services or content except as expressly permitted in writing.

The user must not use the Services in any way that is unlawful, harmful, abusive, fraudulent, infringing, defamatory, invasive of privacy, or disruptive to AlchemyNow, its users, or its service providers. The user must not introduce malware, attempt to bypass security features, or use automated systems to access the Services in an unauthorized manner.

Intellectual Property

All content on the Services, including meditation recordings, text, branding, graphics, logos, site design, compilations, and related materials, is owned by or licensed to AlchemyNow and is protected by applicable intellectual property laws. Terms for subscription content sites typically include strong protection for site-generated content and restrictions on reuse or redistribution.

Except for the limited use rights expressly granted in these Terms, no rights, title, or interest in the Services or any content are transferred to the user. Users may not reproduce or redistribute meditation content outside the permitted scope of personal use without prior written consent.

Health and Wellness Disclaimer

AlchemyNow provides meditation, mindfulness, and wellness-oriented content for educational and informational purposes only. The Services are not medical care, mental health treatment, psychotherapy, crisis response, or a substitute for professional medical, psychological, or therapeutic advice, diagnosis, or treatment.

Users should seek appropriate professional guidance for medical or mental health concerns. If a user is experiencing an emergency or crisis, the user should immediately contact local emergency services or a qualified health professional.

Children and Family Use

AlchemyNow offers family-oriented content, but memberships must be purchased and managed by an adult account holder. The adult account holder is responsible for determining whether specific content is appropriate for children in the household and for supervising minors’ use of the Services.​

AlchemyNow does not knowingly enter into contracts directly with children and does not intend for children to independently create paid accounts without adult involvement. If AlchemyNow becomes aware that personal information has been submitted in a manner inconsistent with applicable law, it may take appropriate steps to delete or restrict that information.​

Third-Party Services

The Services may rely on or link to third-party platforms, processors, or tools, including Squarespace and Stripe. These third parties may have their own terms, privacy policies, and operational practices, and AlchemyNow is not responsible for the content, availability, or policies of third-party services except as required by law.

Payment processing is handled by Stripe through Squarespace according to the payment and privacy terms applicable to those providers. Users are responsible for reviewing any third-party terms that apply to their use of payment, hosting, email, or linked services.

Privacy

Personal information is collected, used, and disclosed in accordance with AlchemyNow’s Privacy Policy. Subscription sites should maintain separate privacy and terms documents because privacy policies explain data practices while terms documents govern contractual use of the service.

Termination

AlchemyNow may suspend or terminate a user’s access to the Services at any time, with or without notice where permitted by law, if the user violates these Terms, fails to pay applicable fees, misuses the Services, creates risk for AlchemyNow or others, or if the Services are discontinued. Upon termination, the user’s right to use the Services ends immediately, but provisions that by their nature should survive termination will continue to apply.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law. AlchemyNow does not guarantee that the Services will be uninterrupted, error-free, secure, or suitable for every user’s expectations, results, or circumstances.

Limitation of Liability

To the maximum extent permitted by law, AlchemyNow and its owners, affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to the Services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, AlchemyNow’s total liability for any claim arising out of or relating to the Services will not exceed the greater of the amount paid by the user to AlchemyNow for the Services in the twelve months preceding the event giving rise to the claim or 100 CAD.

Indemnity

The user agrees to indemnify, defend, and hold harmless AlchemyNow and its owners, affiliates, contractors, and service providers from and against claims, losses, liabilities, damages, judgments, and expenses arising out of or related to the user’s misuse of the Services, violation of these Terms, infringement of rights, or violation of law.

Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Canadian website terms commonly identify a Canadian province and applicable federal law as the governing law framework.

Subject to any rights a consumer may have under applicable law, the courts located in British Columbia will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.

Changes to These Terms

AlchemyNow may update these Terms from time to time. When changes are material, AlchemyNow may provide notice by posting the updated Terms on the website, updating the effective date, or using another reasonable method. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
